Most DUI crimes are misdemeanor offenses, but there are a few ways in which a drunk driving offense can become a felony. Under Florida law, the following offenses constitute a felony DUI:
- A third DUI offense in a 10-year period
- A fourth DUI offense at any time
- A first or subsequent DUI offense causing serious bodily injury
If you have been charged with felony drunk driving, contact the Law Offices of Mark L. Horwitz in Orlando, Florida. With more than 50 years of combined experience in criminal defense, our attorneys are prepared to provide the sound advice and vigorous representation you need.
Protect Your Rights
Having a skilled defense attorney is important in any DUI case, but it is absolutely essential in a felony DUI case. If convicted of felony DUI, you could be sentenced to serve time in a state prison. A fourth DUI or a third DUI in 10 years is a third degree felony, which carries a five-year maximum prison sentence. Additional penalties may include significant court fines, court ordered alcohol treatment and placement of an interlock ignition device in your vehicle for a significant duration of time (at least two years if this is your third DUI offense in 10 years).
Fortunately, there are many ways we can fight your charges:
- Did the police have sufficient cause to stop your vehicle? If not, we could possibly get your charges dismissed entirely.
- Did the police fail to property administer your blood or breath test?
- Did the police fail to properly administer your field sobriety tests?
We will examine the facts of your case to determine if we can use any police errors to your advantage. Building a strong defense can help in three ways. First, it provides leverage for a better plea bargain. Second, we may be able to seek a case dismissal in limited circumstances. Third, it improves your chances for a not guilty verdict at trial if you decide to fight your charges.
